Fair isn’t everybody getting the same thing. Fair is everybody getting what they need in order to be successful.
Section 504 of the Rehabilitation Act of 1973 is a civil rights statute which provides, "No otherwise qualified individual with handicaps in the United States...shall solely by reason of his/her handicap, be excluded from participation in...or be subjected to discrimination under any program receiving federal financial assistance." 29 USC § 794. Since all public school districts receive federal funds, all public school districts must comply with Section 504. Under Section 504, denying a disabled student a free appropriate public education constitutes disability discrimination. To be protected under Section 504, a student must be determined to: (1) have a physical or mental impairment that substantially limits one or more major life activities; or (2) have a record of such an impairment; or (3) be regarded as having such an impairment.
Fayetteville City Schools takes its responsibility to provide a free and appropriate public education to ALL students very seriously. Students suspected of having a disability are evaluated and, if needed, served via an IEP or a 504 plan, depending on eligibility and needs.
